We regularly assist tenants who are at risk of losing their home as a result of landlords commencing proceedings to obtain possession. We take as much of the stress away as possible from our clients by undertaking all the work that is necessary in order to defend their case. During the initial meeting we review the Section 8 or 21 notice that has been served upon our clients as well as any claim forms that have been prepared and submitted by their landlords
The most common reasons landlords seek possession are due to rent arrears or anti-social behaviour and so we ensure that a full account is provided in defence of why the Tenant is in arrears and or the tenants response to any alleged anti-social behaviour. On behalf of the tenant we prepare a defence statement that sets out their side of the coin. We help clients who are on benefits or low incomes apply for legal aid so that they do not have to worry about funding their legal fees.
Margaret Dodson regularly assists tenants with their case from beginning to end, including representing tenants at Court. Over the years our solicitors have represented many vulnerable clients who have at some point been homeless. Tenants are often concerned that if evicted they will be found intentionally homeless by the Council and therefore will not be offered any help and support once the bailiffs come knocking.
